Arbitration and Mediation

Arbitration is a great form of alternative dispute resolution.  Arbitration is intended to resolve a wide variety of disputes outside of court.  What makes arbitration so beneficial to parties? Business clients often greatly prefer the private forum for resolving their disputes.  Business clients also prefer the efficiency of arbitration versus court cases especially when it comes to cutting through discovery and minimizing traditional and ever-increasing costs of discovery.  This means that overall, arbitration tends to save both time and money when disputes arise.  Arbitration provisions may also include class action waivers that appeal to the party drafting the contract and arbitration provision.  An arbitration award is also binding and final with little exception.

Arbitration’s occur as a result of an agreement between parties to go to arbitration.  Most often, the contract your business or you entered into has an arbitration provision. Arbitration may then be triggered by any party to that contract even if one party initially files a lawsuit in court when a dispute arises stemming from that contract.

Connecticut courts are pro arbitration.  I have repeatedly found that Connecticut courts are inclined to grant motions to compel arbitration by parties to a contract which incorporates an arbitration provision.  Case law also suggests that arbitration awards which may be filed with a court and adopted as an order of the court are most often upheld if contested.
